To the maximum extent permitted by applicable law, etoro Analyse einblick, its officers, directors, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, loss of data, loss of goodwill, service interruption, computer damage, or system failure, arising out of or in connection with your use of the Platform.
Our total liability to you for any claims arising from your use of the Platform shall not exceed the total fees paid by you to us in the twelve months preceding the event giving rise to the claim.
Some jurisdictions do not allow the exclusion or limitation of certain types of liability, so the above limitations may not apply to you in full. In such cases, our liability shall be limited to the greatest extent permitted by applicable law.
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which the relevant etoro Analyse einblick entity is incorporated, without regard to its conflict of law principles.
Any dispute, controversy, or claim arising out of or relating to these Terms or your use of the Platform shall first be subject to good-faith negotiation between the parties. Notwithstanding the foregoing, either party may seek injunctive or other equitable relief from a court of competent jurisdiction to prevent irreparable harm pending the resolution of any dispute.
